These Terms of Service ("Terms") govern your use of the TripScout iOS application and website at tripscout.app, operated by TripScout ("we", "our", or "us"). By downloading or using TripScout, you agree to these Terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 13 years old to use TripScout. By using the app you represent that you meet this requirement.

2. License to Use

TripScout is free to download and use. We grant you a limited, non-exclusive, non-transferable, revocable licence to use TripScout on your Apple device for your own personal, non-commercial travel planning purposes. You may not copy, modify, distribute, sell, or lease any part of the app, nor may you reverse-engineer or attempt to extract the source code.

3. AI-Generated Content

TripScout uses artificial intelligence to generate travel itineraries. You acknowledge that:

  • AI-generated itineraries are suggestions only and may not reflect current conditions, opening hours, prices, or availability.
  • You are solely responsible for verifying information before acting on it, including checking entry requirements, visa rules, and travel advisories for your destination.
  • TripScout is not a licensed travel agent and does not make bookings on your behalf.
  • Itinerary content is generated for your personal use. You may save and share your itinerary, but you may not resell AI-generated content or use it for commercial purposes.

4. Acceptable Use

You agree not to:

  • Use TripScout for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of TripScout's systems or infrastructure.
  • Use automated means (bots, scrapers) to access or extract content from TripScout.
  • Submit false, misleading, or offensive content as trip inputs.
  • Interfere with the proper functioning of the app.

5. Intellectual Property

The TripScout name, logo, app design, and underlying software are the intellectual property of TripScout and are protected by applicable copyright and trademark law. Nothing in these Terms grants you any right to use our brand assets without prior written permission.

AI-generated itinerary content is provided to you for your personal use. We do not claim ownership of the specific output generated in response to your inputs.

6. Third-Party Services

TripScout relies on third-party services including AI providers and Apple Maps. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

7. Disclaimer of Warranties

TripScout is provided "as is" and "as available" without warranty of any kind. We do not warrant that the app will be uninterrupted, error-free, or that AI-generated itineraries will be accurate, complete, or suitable for your specific trip. Travel involves inherent risks; you assume full responsibility for your travel decisions.

8. Limitation of Liability

To the fullest extent permitted by applicable law, TripScout and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to losses arising from reliance on AI-generated itinerary content. Our total liability to you for any claim shall not exceed $1 USD.

9. Apple App Store Terms

TripScout is distributed via Apple's App Store. Your use of the app is also subject to Apple's Media Services Terms and Conditions. Apple is not a party to these Terms and has no obligation to provide any support or maintenance for TripScout. In the event of any conflict between these Terms and Apple's terms, Apple's terms govern solely with respect to your relationship with Apple.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "last updated" date. Continued use of TripScout after changes are posted constitutes your acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which TripScout is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
